INFORMATION ON THE TREATMENT OF PERSONAL DATA

2. Subject of the processing
The holder processes personal, identifying, and non-sensitive data (name, surname, e-mail, date of birth), communicated by You during the registration/account creation on the www.bookyway.com website.
3. Purpose of the Treatment
Your personal data will be processed lawfully and correctly in accordance with the provisions of the EU Reg. No. 679/2016 and European legislation, for the following purposes:
a) Without your express consent, to allow you to create an account and use BookyWay and, therefore, to enable Gymtrainer s.r.l. to execute contractual obligations with you.
b) Only with specific and separate prior consent and until the revocation of the same:: Your email will be used to send our newsletter regarding communications relating to gymtrainer services (such as new features) and possible related or connected to commercial offers to our services and our activities.
c) At any time, you can oppose the treatment of art. 3B and, therefore, to the sending of our newsletter, through a unique link at the bottom of any newsletter sent by Gymtrainer srl. Failure to consent to the purposes referred to point 3B will in no way affect the ability to register yourself on the site and to use the services offered by BookyWay.
4. Duration of Treatment
The owner will process your personal data for the time necessary to fulfill the purposes mentioned above and, therefore, for the entire duration of the contractual relationship with you.
5. Communication of data
Your data will be accessible, for the aforementioned purposes, to the employees and collaborators of the owner who act under his direct authority, as well as to external subjects that perform activities in outsourcing on behalf of the owner in their quality of data controllers, and specifically to persons / companies that perform services connected and instrumental to the execution of the purposes indicated above. The updated list of responsible and appointee of data processors is kept at the owner’s headquarters and can be viewed on request by sending a registered letter or e-mail at the addresses indicated in point 1.
6. Place of Data retention
6.1. Personal data will be stored On the server of the company „Microsoft, through their „Azure“ cloud computing platform and services, currently located in the West Europe datacenter in Amsterdam, duly appointed as Data Processor
6.2. On Sendgrid, a mailing service for the sole purpose of sending notifications related to your activities to end users, your customers (eg, confirmation of registration for courses), and, therefore, exclusively associated with the regular use of BookyWay services.
7. Rights of the interested party
In your quality of interested you can at any time exercise your rights:
a – to access personal data
b – to rectify or delete personal data
c – to limit the processing of personal data
d – to oppose the treatment
e – the portability of personal data
f – to withdraw consent
g – to lodge a complaint with the supervisory authority.
The exercise of your rights may take place by sending a registered letter or e-mail at the addresses indicated in point 1.
8. Appointment to personal data processing manager
8.1. By accepting the contract for the use of our services, you expressly appoint the company Gymtrainer s.r.l. as responsible for the processing of personal data of your customers that you will insert within our system; personal data of which you are the sole holder of the treatment and of which you assume all responsibility regarding the acquisition of the consent to the treatment of the same.
8.2. By accepting the contract for the use of our services, you expressly authorize Gymtrainer srl to appoint persons and companies that carry out related and instrumental services with exclusive rights as the data processors of the processing of personal data of your customers included in our system purpose of allowing the execution of the contract with the express exclusion of their use for marketing or profiling purposes. The Data Processors appointed by Gymtrainer srl are committed to confidentiality and have assumed the same obligations that Gymtrainer srl has assumed towards the data controller. Gymtrainer srl retains any liability towards the data controller for the fulfillment of the obligations of the managers appointed by it. The updated list of those responsible is kept at the Gymtrainer srl headquarters and can be viewed on request by sending a registered letter a.r. at Gymtrainer s.r.l.
9. Processing of your customer data entered into our system
9.1. The personal data of your customers inserted in our system, will be transmitted to Gymtrainer srl with the exclusive purpose of allowing the execution of the contract and, therefore, to provide to you and to them, all the services and features of BookyWay, with the express exclusion of their use for marketing or profiling purposes. More in detail, Gymtrainer s.r.l. will use the personal data received to create the account of your customers entered into our system and send them the relevant credentials via e-mail.
9.2. The personal data of your customers entered into our system, processed by Gymtrainer srl, are exclusively the data required for the creation of the end-user account: name, surname, e-mail, date of birth.
9.3. Gymtrainer srl securely stores the personal data it comes into possession of, taking all appropriate measures against the loss, destruction, or damage of the same. The data will be stored until the achievement of the purposes for which they are processed and, therefore, until the expiry of the contract, when the data will be deleted, and the owner will be informed by e-mail.
9.4. Gymtrainer srl assures you of having taken every measure necessary to guarantee the exercise of the rights of the interested party: you have the right to access the personal data of your customers included in our system, processed by Gymtrainer srl, as you are entitled to their cancellation, rectification and return if requested by the interested party. These data will be viewed by accessing the personal account from the BookyWay platform. The processed data may be canceled or rectified promptly through the dedicated functionality on the platform. In particular, data such as name, surname, and email address, for security reasons cannot be modified but only deleted.
10. Nature of data provision
The communication of your personal data is a fundamental requirement to conclude the contract and to give it execution, otherwise, you will not be able to obtain the credentials necessary to download the BookyWay software.
11. Minors
Gymtrainer s.r.l. Provides its services only to those over 16; the holder, therefore, does not intentionally collect personal information referring to minors under the age of 16. If the information on minors is unintentionally registered, the holder will delete them promptly, at the request of the holder of parental responsibility.
